The short version. Tally Plans costs £29 a month and you can cancel any time. Plans are estimates to help you decide, not guarantees or financial advice. Your data stays in your browser, so keep your own backups.
1. About these terms
These terms apply to your use of the Tally Plans website, free demo and full planner (together, "the service"). Tally Plans is a sole trader business based in the UK, run by Oliver Green ("we", "us"). Our postal address is 2 Crannacombe Cottages. You can contact us at oligreen55@icloud.com. By using the service, or by subscribing, you agree to these terms. Please also read our privacy policy and cookie policy.
The service is designed for businesses. If you use it as a consumer, for purposes unrelated to a business, you also have legal rights that these terms do not affect.
2. The free demo
The free demo is a made-up store you can explore without signing up. It is limited to 3 products and 20 transactions. It is provided as it is, free of charge, and we may change or withdraw it at any time.
3. Subscriptions and payment
- The full planner costs £29 per month, or the price shown on our website when you subscribe. Payments are taken by card through our payment provider, Stripe.
- Your subscription renews automatically each month, and you are charged on the same date each month until you cancel.
- We will give you at least 30 days' notice by email of any price change. The new price will apply from your next payment after the notice ends. You can cancel before then if you don't want to continue.
- If a payment fails, we may pause your access until it is paid.
4. Cancelling
- You can cancel any time through Stripe's customer portal, using the link in your payment receipt, or by emailing us. Your access continues until the end of the month you have already paid for, and you won't be charged again.
- We don't give refunds for part-months, except where the law requires it.
- If you are a consumer, you have the legal right to cancel within 14 days of first subscribing. Because the service starts as soon as you pay, you ask us to provide it straight away. If you cancel within the 14 days, you may have to pay for the days you have already used.
5. Your account
- Accounts are created by invitation after payment. Your account is for you and your business. Don't share your login with anyone outside your business.
- Keep your password secure, and tell us straight away if you think someone else has used your account.
- We may suspend or close an account that is used to break these terms or the law, or that puts the service or other users at risk. Where reasonable, we will tell you first.
6. Your data
Everything you enter or import into the planner is stored in your own browser on your own device. We don't receive it and can't recover it. You are responsible for keeping your own copies of your data and Shopify exports. Clearing your browser data, using a different browser or device, or using private browsing will mean your planner data isn't available. The privacy policy explains how we handle the personal data we do hold.
7. Plans are estimates, not advice
Tally Plans helps you plan stock orders and cash flow from the numbers you provide and typical seasonal patterns. Its order dates, quantities, forecasts and holiday dates are estimates. They are not guarantees, and they are not financial, accounting, tax or legal advice. Results depend on the accuracy of your data, and the service can't predict sales, supplier behaviour or events. Always check supplier closure dates with your suppliers. You remain responsible for your own buying and business decisions.
8. Acceptable use
You agree not to copy, resell or redistribute the service, get round its access controls or usage limits, interfere with its security or operation, or use it for anything unlawful.
9. Ownership
We own the Tally Plans software, design and content, or we are licensed to use them. While your subscription is active, we give you a non-exclusive, non-transferable right to use the service for your business. You keep all rights to your own data.
10. Availability and changes
We aim to keep the service available and working well, but we can't promise it will always be uninterrupted or error-free. We may improve or change features from time to time. If we make a change that significantly reduces what you've paid for, we will tell you, and you can cancel.
11. Our liability
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited or excluded by law.
- If you use the service for business, we are not liable for loss of profits, sales, business, revenue or data, or for any indirect or consequential loss. Our total liability to you is limited to the amount you paid us in the 12 months before the claim arose.
- If you are a consumer, we are responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that was not foreseeable, and the service is not provided for business losses.
12. Ending the service
We may stop offering the service by giving you at least 30 days' notice by email. If we do, we will refund any payment covering the period after it ends.
13. Changes to these terms
We may update these terms from time to time, and the date at the top shows when they last changed. For significant changes we will email you at least 30 days in advance. If you continue to use the service after that, you accept the new terms.
14. Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you can also bring proceedings in your local courts. If you have a problem, please email us first, as most issues can be sorted out quickly.
